With this practical scenario as a basis, the following topics were discussed: Responsibilities (blame), claims from both ships, jurisdictions and limitation of liability.
Marine crisis management
Representatives from Holman, Fenwick & Willan gave a lecture from London concerning the topic "Marine crisis management and casualty investigation", while the law firm of Thommessen provided an update on the latest developments in maritime law. The matter of statute-barred claims and particularly collision liability were also on the agenda for participants from NHC and the law firms.
"This type of professional gathering undoubtedly contributes to a broader understanding and increased professional expertise for the participants. In fact, the content was of such high quality that we are considering making it available to a wider audience which would include representatives for the ship owners," says the director of the legal department at Norwegian Hull Club, Per-Åge Nygård.
Provide sound advice
Key legal issues relating to the scope of maritime law and maritime insurance law were thoroughly explained for participants.
"Anyone who is involved in marine casualty matters at NHC shall possess extensive knowledge of the scope of maritime insurance law. In order to be able to conduct the best possible handling of casualty cases - including the ability to provide sound advice to our clients - it is also essential that we have updated and extensive knowledge of issues related to general maritime law," says seminar participant, Roar Sanden, who is an attorney at NHC's Bergen office.
Norwegian Hull Club will at a later date extend invitations to representatives of the ship owners to future seminars at which maritime law will be among the main topics.
