New German H&M Clauses presented for Cefor members

On behalf of the Cefor Academy Dr. Dieter Schwampe and Dr. Jan Dreyer from the German law firm Dabelstein & Passerl visited Oslo and Bergen to show the presentation of the new German Hull & Machinery Clauses DTV-ADS 2009. These clauses will replace today’s clauses from 1919 (ADS 1919).

"The connection between German and Norwegian law is off course particularly interesting for Norwegian marine insurance companies. Germany is a major market for Scandinavian marine underwriters, and there are tight connection to German shipping companies and German brokers. In many cases insurance contracts combine German and Nordic insurance conditions. The rights of the leading underwriter were also a topic of discussion today," says Dr. Schwampe after the presentation.


Dr. Schwampe is considered an expert in the field of maritime law, and is today President in the German Law Association and Chairman the International Working Group Marine Insurance, Comité International Maritime (CMI). He has been partner in D&P since 2000.
Dr. Dreyer has been partner since 1996 and is Senior Vice Chair Maritime & Transport Committee International Bar Association, and member of the supervisory board of a ship finance corporation.
